These Terms & Conditions constitute a legally binding agreement between Miss Davis Tutoring & Performance Limited ('we', 'us', 'our') and the parent or guardian ('you') who subscribes on behalf of a student. Please read them carefully before purchasing a subscription.

By completing a subscription purchase, you confirm that you have read, understood, and agreed to these Terms & Conditions. If you do not agree, do not proceed with the purchase.

1. Who This Service Is For

Miss Davis Tutoring & Performance Limited provides online educational subscription services for children aged 5 to 16 who are based in the United Kingdom.

  • Subscriptions are purchased by a parent or legal guardian on behalf of a child.
  • The parent or guardian must be aged 18 or over and be legally resident in the United Kingdom.
  • Primary programmes are designed for children aged 5 to 11.
  • GCSE programmes are designed for students aged 14 to 16.

By subscribing, you confirm that you are the parent or legal guardian of the student named on the account, that you have parental responsibility for that child, and that you consent to their participation in our programmes.

We reserve the right to verify age eligibility and to suspend or cancel accounts where the student does not meet the stated criteria.

2. Parental Consent

Because all students on our platform are minors (under the age of 18), parental or guardian consent is mandatory. By creating an account and completing a subscription, you:

  • Confirm you hold parental responsibility for the named student.
  • Consent to the student accessing our platform, attending live sessions, and engaging with tutors and other students in a supervised group environment.
  • Consent to the collection and processing of your child's personal data as described in our Privacy Policy, in accordance with UK GDPR and the ICO Children's Code.
  • Accept responsibility for ensuring your child uses the platform in an appropriate and respectful manner.

If parental responsibility changes or you wish to withdraw consent, you must notify us immediately at info@missdavistutoring.com.

3. Subscription Plans — What Is and Is Not Included

We offer two programme categories: GCSE (ages 14–16) and Primary (ages 5–11). Each category has three tiers. Your subscription provides access to the features listed for your chosen plan only. Features from higher tiers are not included unless you upgrade.

Annual subscriptions are charged at a 20% discount on the monthly rate. The annual price is collected upfront as a single payment.

We do not guarantee specific academic outcomes or grade improvements. Our programmes are designed to support learning — results depend on individual student effort, engagement, and circumstances beyond our control.

4. Free Trial

New subscribers receive a 7-day free trial. No payment is taken during the trial period.

  • If you do not cancel before the trial ends, your subscription activates automatically and your first payment is taken.
  • The free trial is available once per household. It may not be combined with any other promotion or discount.
  • We reserve the right to withdraw or modify the free trial offer at any time for new sign-ups, without affecting existing trial users.

5. Billing, Payment, and Price Changes

5a. Payment Processing

All payments are processed securely by Stripe. By subscribing, you authorise us to charge your chosen payment method on a recurring basis (monthly or annually) until you cancel. We do not store card details on our systems.

5b. Failed Payments

If a payment fails, we will attempt to collect it again. Our retry schedule is as follows:

  • Attempt 1 — on the scheduled billing date.
  • Attempt 2 — 3 days after the first failure.
  • Attempt 3 — 3 days after the second failure.

If all three attempts fail, your account will be suspended and access to the platform will be removed. You will be notified by email at each stage. To reactivate your account, you must update your payment details and settle any outstanding balance.

5c. Price Changes

We reserve the right to change subscription prices. Where a price increase affects your current plan, we will give you a minimum of 30 days' written notice by email before the change takes effect.

If you do not wish to continue at the new price, you may cancel before the change takes effect and retain access until the end of your current billing period. Continued use of the service after the notice period constitutes acceptance of the new price.

6. Cancellation and Refunds

Our full Refund & Cancellation Policy is a separate document available on our website and should be read alongside these Terms. The key points are summarised here for convenience:

  • You may cancel at any time by emailing info@missdavistutoring.com. Allow 3–5 business days for your request to be processed.
  • Monthly subscribers retain access until the end of their current billing period. No partial refunds are issued for unused days.
  • All new subscriptions (monthly and annual) are covered by a 14-day full refund guarantee, beginning on the date of sign-up.
  • Annual subscriptions cancelled after 14 days are non-refundable in cash. Remaining value may be taken as account credit, transferred to another student, or the subscription may be paused for up to 90 days.
  • Pause requests must be submitted by email before your next billing date. Pauses are available from day 15 of an annual subscription and may be used once per annual term.

Your statutory rights under the Consumer Contracts Regulations 2013 and Consumer Rights Act 2015 are not affected by these terms.

7. Account Suspension and Termination

7a. Suspension for Non-Payment

As set out in Section 5b, accounts will be suspended following three consecutive failed payment attempts. Suspension removes access to all platform content, live sessions, and resources until the outstanding balance is cleared.

7b. Suspension for Misuse

We operate a one-warning policy for misuse. The following behaviours will result in an immediate warning and may result in account suspension or permanent termination without refund:

  • Sharing account login credentials with anyone outside the named student's household.
  • Allowing more than one student to use a single-student subscription simultaneously.
  • Downloading, copying, or distributing any platform content, worksheets, videos, or materials without our written permission.
  • Any conduct by the student or parent that is abusive, threatening, or disruptive toward tutors, staff, or other students.
  • Any attempt to circumvent platform security, access controls, or payment systems.

Account sharing is not permitted under any circumstances. Where we detect that an account is being used by more than the named student, the account will be suspended immediately. A written warning will be issued for a first offence. A second offence will result in permanent termination without refund.

7c. Our Right to Terminate

We reserve the right to terminate any account at our discretion where we have reasonable grounds to believe these Terms have been breached, where continued access poses a risk to other users or to our staff, or where required by law. Where termination is at our instigation without cause, we will provide a pro-rata refund for any unused subscription period.

8. Intellectual Property

All content on our platform — including but not limited to worksheets, revision materials, mock exams, video recordings, lesson plans, frameworks, and branded assets — is the sole intellectual property of Miss Davis Tutoring & Performance Limited.

  • Subscribers are granted a limited, non-transferable, non-exclusive licence to access and use platform content for the personal educational use of the named student only.
  • You may not reproduce, distribute, sell, share, upload, or otherwise exploit any platform content without our prior written consent.
  • Recording of live sessions is strictly prohibited unless we have given explicit written permission.
  • Any unauthorised use of our content may result in immediate account termination and may constitute copyright infringement under the Copyright, Designs and Patents Act 1988.

9. Data Protection and Children's Privacy

Miss Davis Tutoring & Performance Limited is registered with the Information Commissioner's Office (ICO) as a data controller and processes personal data in accordance with UK GDPR and the Data Protection Act 2018.

Because our services are used by children aged 5 to 16, we apply additional safeguards in line with the ICO's Children's Code. In particular:

  • We collect only the minimum data necessary to deliver the service.
  • We do not profile children for marketing or advertising purposes.
  • Children's data is never sold or shared with third parties beyond our named data processors (Stripe, Google Workspace, LearnDash, and Mailchimp).
  • The parent or guardian is the account holder of record and all data rights are exercised through them.

Full details of how we collect, use, store, and protect personal data are set out in our Privacy Policy, which forms part of these Terms and should be read alongside them.

10. Service Availability and Changes

We aim to provide a consistent, high-quality service. However, we do not guarantee uninterrupted access to the platform at all times.

  • Scheduled maintenance will be communicated in advance where possible.
  • In the event of technical issues beyond our control, we will work to restore access as quickly as possible. We are not liable for losses resulting from platform downtime.
  • We reserve the right to modify, update, or discontinue features of any subscription tier with reasonable notice. Where a material feature is removed, we will notify you and offer a plan adjustment or cancellation option.
  • Live sessions are delivered at scheduled times. Where a session is cancelled by us, we will reschedule it or offer a credit. We are not able to offer refunds for sessions missed due to the student's absence.

11. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any failure to achieve specific academic results or grade outcomes.
  • We are not liable for indirect, consequential, or economic losses arising from use of or inability to use our platform.
  • Our total liability to you in connection with any subscription shall not exceed the total amount paid by you in the 12 months preceding the claim.

Nothing in these Terms excludes our liability for death or personal injury caused by our negligence, fraud, or any other matter that cannot be excluded by law.

12. Governing Law and Disputes

These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you have a complaint or dispute, please contact us first at info@missdavistutoring.com. We are committed to resolving issues fairly and promptly. If we are unable to reach a resolution, you may refer the matter to an appropriate alternative dispute resolution scheme or the courts.

13. General

  • These Terms constitute the entire agreement between you and Miss Davis Tutoring & Performance Limited in relation to your subscription.
  • If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
  • Our failure to enforce any right under these Terms does not constitute a waiver of that right.
  • We may update these Terms from time to time. We will notify you of material changes by email with a minimum of 30 days' notice. Continued use of the service constitutes acceptance.
  • These Terms do not create any partnership, agency, or employment relationship between us.

Important Notice: Because this service processes children's personal data and involves minors as end users, these Terms & Conditions must be reviewed by a qualified solicitor before publication. Do not publish without independent legal review.
